Terms of Service

By accessing or using Aether Finance (the "Platform"), available at aetherterminal.com, including our website, API, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Aether Finance ("Aether," "we," "us," or "our").

To use the Service, you must:

• Be at least 18 years old or the age of majority in your jurisdiction, whichever is greater.
• Have the legal capacity to enter into a binding agreement.
• Not be barred from using the Service under applicable U.S. law or the laws of your jurisdiction.

The Platform is initially focused on users in the United States. Users outside the U.S. may access the Service but do so at their own discretion and are responsible for compliance with local laws.

You may create an account using Google OAuth via Firebase Authentication. By creating an account, you agree to provide accurate and current information associated with your Google account.

You are solely responsible for:

• Maintaining the security of your account credentials and Google account.
• All activity that occurs under your account, whether or not authorized by you.
• Notifying us immediately if you suspect unauthorized access.

Aether is not liable for any loss or damage arising from your failure to maintain account security. Each individual may maintain only one account.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Scrape, crawl, or harvest data from the Platform except through the approved API with valid authentication.
• Reverse engineer, decompile, or disassemble any part of the Platform.
• Redistribute, resell, or sublicense any data obtained from the Platform without prior written permission.
• Use automated tools or bots to access the Service beyond approved API usage within published rate limits.
• Circumvent or attempt to circumvent rate limits, authentication, or other technical restrictions.
• Interfere with or disrupt the Service, servers, or networks.
• Use the Service for any illegal purpose, including securities fraud, market manipulation, or money laundering.
• Impersonate any person or entity, or upload viruses or malware.

The Platform aggregates data from multiple third-party sources, including Norgate Data, SEC EDGAR, GDELT, WHO, World Bank, UN Population Division, Google Patents (BigQuery), IMF, and OECD.

Aether Finance does not guarantee the accuracy, completeness, timeliness, or reliability of any data displayed on the Platform. Specifically:

• Stock prices may be delayed, adjusted differently from real-time exchange feeds, or reflect end-of-day rather than intraday values.
• Fundamentals data is parsed programmatically from XBRL filings and may contain normalization errors, misclassified line items, or gaps.
• News headlines sourced from GDELT may be machine-translated and may be inaccurate or lack context.
• Government and international data (WHO, World Bank, UN, IMF, OECD) may have reporting delays of months or years.

All data is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

All platform code, software, design, UI elements, visualizations, branding, logos, and proprietary algorithms are the exclusive intellectual property of Aether Finance.

Users who publish research posts retain ownership of their content. By posting, you grant Aether Finance a non-exclusive, worldwide, royalty-free, transferable license to display, distribute, reproduce, and promote your content on the Platform. You may delete your content at any time.

Any feedback, suggestions, or ideas you provide about the Service may be used by Aether without obligation or compensation to you.

Research posts, analysis, and commentary published by users may contain personal opinions, speculation, forward-looking statements, or incomplete analysis. Aether Finance is not responsible for user-generated content. No content from other users should be treated as professional financial, legal, or investment advice.

API access is subject to rate limits, currently set at 10–30 requests per minute depending on the endpoint. Abuse may result in temporary throttling, suspension, or permanent revocation of API access.

Aether reserves the right to modify, deprecate, or discontinue any API endpoint at any time. See our API Terms of Service for complete API-specific terms.

To the maximum extent permitted by law, Aether Finance's total cumulative liability shall not exceed the greater of (a) fees paid by you in the preceding 12 months, or (b) $100 USD.

In no event shall Aether be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or trading/investment losses. This includes damages arising from data outages, inaccuracies, or third-party service failures (Google Cloud, BigQuery, Firebase, Vercel, Norgate Data, SEC EDGAR).

You agree to indemnify, defend, and hold harmless Aether Finance from any claims, damages, losses, liabilities, costs, and expenses arising from your use of the Service, violation of these Terms, your user content, your investment decisions, or violation of any applicable law.

These Terms are governed by the laws of the State of Delaware, United States. Disputes shall be resolved by binding arbitration administered by the American Arbitration Association (AAA).

Class action waiver: You agree to resolve disputes on an individual basis only. You waive any right to participate in a class action, class arbitration, or representative proceeding.

Either party may seek injunctive relief in any court of competent jurisdiction to prevent infringement of intellectual property rights.

Aether may suspend or terminate your account at any time for violations of these Terms. You may delete your account at any time through your account settings or by contacting us. Upon deletion, your personal data will be purged per our Privacy Policy.

Sections 5, 6, 7, 10, 11, and 12 survive termination.

Aether may modify these Terms at any time with at least 30 days' notice via email or platform notification. Continued use after the effective date constitutes acceptance. If you disagree, you must stop using the Service and delete your account.

The Platform relies on Google Cloud Platform (BigQuery, Cloud Run, GCS), Firebase, Vercel, Norgate Data, and SEC EDGAR. Aether is not responsible for their availability, performance, or policies.

These Terms, together with the Privacy Policy and API Terms, constitute the entire agreement between you and Aether Finance. If any provision is found unenforceable, it shall be limited to the minimum extent necessary and the remaining provisions remain in effect. Aether's failure to enforce any right does not constitute a waiver.
